LEGAL TERMS AND GENERAL CONDITIONS OF THE SITE

1. INTRODUCTION
Welcome to WhiskyOrigins.com . Accessing and using our site to buy and/or sell whisky and other products constitutes acceptance of these Terms and Conditions. Please read them carefully before placing an order.
1.1 Scope of application
These General Terms and Conditions of Sale apply exclusively to purchases made on Whisky Origins and do not regulate the sale of products and/or the provision of services by parties other than Whisky Origins , even if present on the site via links, banners, or other hypertext links. Therefore, Whisky Origins is not responsible for the provision of services and/or the sale of products by such parties. Whisky Origins does not control and/or monitor the content of such sites, nor is it responsible for any errors, omissions, or violations of law by them.
2. GENERAL CONDITIONS OF SALE

The online sale of products via the Whisky Origins website is governed by current Italian legislation regarding online sales and the right of withdrawal.

By placing an order, you expressly accept these terms of sale and authorize Whisky Origins to charge you the total amount of the purchase, including shipping costs.

Whisky Origins reserves the right to modify these Terms and Conditions without notice. Any updates will be posted on the website and will be effective immediately.
2.1 Purchase Requirements

For Italian citizens, the purchase of alcoholic beverages is permitted only to those who are 18 years of age or older.

Non-Italian users can purchase products only if they are of legal age according to their national law. If there is no specific legislation, the age limit is 21 .

By placing an order on the site, the user declares that he or she complies with the regulations of his or her country regarding purchase limits by age, releasing Whisky Origins from any liability in the event of false declarations.
2.2 Refusal and cancellation of orders
Whisky Origins reserves the right to refuse or cancel any order for any reason, including but not limited to orders from users who:

Have previously violated the Terms and Conditions of Sale;

Have been involved in fraud;

Have provided false, incomplete or inaccurate data;

We have made inauthentic transactions.
3. AVAILABILITY AND PRICES

Product availability is indicative and may vary based on simultaneous sales made by other users, or for other reasons.

If a product is unavailable, the customer will be notified by email or phone. The customer can choose whether to wait for availability (when possible), replace the product (when possible), or exclude it from the order and obtain a refund.

Prices are expressed in Euros (€) and are subject to change without notice.
3.1 Material errors and product availability
Whisky Origins reserves the right to correct material errors in pricing or product descriptions at any time. If a product is incorrectly listed as available, you will be entitled to a refund or an agreed-upon alternative (where possible).
If an order includes multiple products and only some are unavailable, the customer can:

Replace unavailable products with others (when possible);

Receive a partial refund;

Cancel the entire order if the lack of some products compromises its overall validity.
4. PAYMENT METHODS

We accept payments by credit card, bank transfer, PayPal and other methods indicated at checkout .

Your credit card information is encrypted and securely transmitted to the payment processor, without transiting our servers.

Payment must be completed at the time of ordering.
5. SHIPPING AND DELIVERIES

Whisky Origins ships to Italy and throughout Europe via express courier.

Each delivery must be signed for by a recipient legally authorized to receive alcohol.

Delivery times are indicative and subject to change.

Any import taxes or customs duties are the responsibility of the recipient.
6. RIGHT OF WITHDRAWAL AND RETURN
6.1 Right of withdrawal

The customer has the right to withdraw from the purchase contract without having to specify the reason within 14 calendar days from the moment in which he or a designated third party (other than the courier) acquires physical possession of the product.
6.2 Procedure for exercising the right of withdrawal

To exercise the right of withdrawal, the customer must send explicit written communication to Whisky Origins via email or other traceable means of communication, clearly indicating the intention to withdraw from the contract.

The customer is responsible for retaining proof of communication sent to Whisky Origins .
6.3 Product return

The customer must return the products without undue delay and in any case within 14 calendar days from the date on which he communicated the withdrawal.

The return shipment must be made using a carrier of your choice and at your own expense.

The product must be returned to the address communicated by Whisky Origins , adequately protected and packaged to avoid damage during transport.

The customer is responsible for any diminished value of the product resulting from handling other than that necessary to establish its nature, characteristics and functioning.
6.4 Refund

Whisky Origins will refund the amount paid by the customer for the product, including standard delivery costs, within 14 days of receiving the withdrawal notice.

The refund will be made using the same payment method used by the customer for the initial transaction, unless otherwise agreed between the parties.

The refund may be withheld until the returned product has been received and verified as intact.
6.5 Exceptions to the right of withdrawal
The right of withdrawal does not apply in the following cases:

Customized or made-to-measure products.

Alcoholic beverages whose price depends on market fluctuations beyond the control of Whisky Origins .

Sealed products which, for hygiene or health protection reasons, cannot be returned after the original seal has been opened.
If the customer returns a product that falls within one of these exceptions, Whisky Origins reserves the right to refuse the refund.
7. WARRANTY AND DEFECTIVE PRODUCTS

In the event of defects in conformity, Whisky Origins will replace the product or refund the amount paid.

The warranty does not cover damage resulting from inadequate packaging, climatic conditions or natural aging of the product.
8. RESPONSIBILITY AND LIMITATIONS

Whisky Origins is not responsible for:

Indirect or consequential damages resulting from the use of the purchased products.

Loss or damage to products due to transportation conditions beyond our control.

Authenticity and suitability for consumption of historical and collectible products.

9. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed by Italian law.
